“Surrogacy arrangements are not common in Australia and are quite technical in nature. The Surrogacy Act 2010 (NSW) allows for an application to be made to the Supreme Court for a transfer of parentage from the surrogate to the intended parent. Each state in Australia has different and specific legislation that needs to be complied with, so it is important that all parties receive legal advice from a solicitor experienced in this area of law prior to entering into a surrogacy agreement,” Sasha said.
“Donor agreements are not legally binding, but so important to consider having prepared for clients who are looking at going down this path. It’s likely there are aspects that the parties have not properly considered. Parties should receive comprehensive advice to ensure that everyone is on the same page, particularly in relation to intentions about future or ongoing involvement once the child is born – and the implications that might have,” she said.
